Terms of Service
Effective April 1, 2026
These Terms of Service (the “Terms”) govern your access to and use of NoShow Rescue (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
NoShow Rescue is a software platform that helps appointment-based businesses recover revenue from cancelled appointments. It records appointments, ranks waitlist customers against freed slots, sends refill offers and reports on recovered revenue.
The Service is provided as software only. We do not contact your customers on your behalf except through messaging you configure and initiate, and we do not guarantee that any particular appointment will be refilled.
2. Accounts
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your password confidential.
- You are responsible for all activity that occurs under your account.
- You must be at least 18 years old and able to enter into a contract.
- One person or business per account unless you are on a plan that includes team members.
3. Acceptable use
You agree not to:
- Use the Service to send unsolicited marketing to people who have not opted in.
- Upload data you do not have the right to process.
- Attempt to access another customer’s data or the administrative area.
- Probe, scan or test the vulnerability of the Service without written permission.
- Resell or white-label the Service without a written agreement.
4. Your customer data
You own the customer and appointment data you put into the Service. You are the controller of that data and we process it on your behalf to provide the Service. You are responsible for having a lawful basis to contact your customers, including obtaining consent for SMS or email where the law requires it.
5. Messaging
By default the Service records messages in a simulated inbox and does not transmit them. If you connect a third-party messaging provider such as Twilio or an email provider, you are responsible for complying with that provider’s terms and with applicable messaging law, including the Telephone Consumer Protection Act and CAN-SPAM.
6. Subscriptions and payment
- Plans are billed monthly in advance in US dollars.
- Payment is processed by Stripe. We do not store your card details.
- Your subscription renews automatically each month until you cancel through the billing screen in your dashboard.
- Prices may change with at least 30 days’ notice. Changes never apply to a period you have already paid for.
- Plan limits, including appointment volume and locations, are described on the pricing page.
Refunds are handled under our Refund Policy.
7. Availability
We work to keep the Service available, but we do not promise uninterrupted access. We may suspend the Service for maintenance, and we may modify or discontinue features. If we discontinue the Service entirely, we will give you reasonable notice and the ability to export your data.
8. Suspension and termination
We may suspend or terminate your account if you breach these Terms, if payment fails repeatedly, or if your use puts the Service or other customers at risk. You may cancel at any time. On cancellation, your access continues until the end of the period you have paid for.
9. Demonstration data
The Service includes a demonstration business and demonstration performance figures. All such figures are fictional, are labeled as fictional, and must not be presented to anyone as real customers, real revenue or real historical performance.
10. Disclaimers
The Service is provided “as is” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. Estimates the Service produces — including no-show risk, projected losses and recovery figures — are informational and are not professional, medical or financial advice.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost revenue.
12. Changes to these Terms
We may update these Terms. If a change is material we will notify you by email or in the application before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
